With the stock market at record highs, the economy humming along and no involvement in major wars, one would think America would be content. We are not. Why?
It is because America’s elite believe that public policy should be determined by judges, not elected representatives. President Trump viscerally grasped the power of this issue early in his campaign. This non-religious, twice-divorced, well-known Playboy galvanized a large portion of the Republican base – religious conservatives – by promising to appoint judges who interpret the law rather than invent it. He even listed the names of well-known conservative judges that he would appoint. Since his election, he has scrupulously kept this promise, with two conservative Supreme Court choices and 142 federal judge appointees.
But the media, the Democrats, the academic community and the tech oligarchs are livid with President Trump for his success in this area. In their view, many of America’s injustices to women, the poor, minorities and the sexually avant garde are due to what they perceive to be an antiquated Constitution that is very difficult to amend – requiring two-thirds of each legislative branch and then three-fourths of the states. Furthermore, the legislative process is tedious.
Thus, for the past two generations, social policy has been determined by judges. Because of the Supreme Court, porn and filth pollute our televisions and internet (Ashcroft v. Free Speech Coalition). Because of the Supreme Court, abortion is legal for nine months (Roe v. Wade), gay marriage is legal (Obergefell v. Hodges) and corporations can confiscate the houses of working people in favor of corporations willing to pay higher taxes (Kelo v. City of New London). Because of the Supreme Court illegal immigrants have the right to free health care and to free education (Plyler v. Doe).
Perhaps if these policies had been effective, America would have accepted them. For example, the Planned Parenthood crowd predicted that the rate of out-of-wedlock births would decrease with legalized abortion. What actually happened was the opposite, as anyone with a normal libido could have predicted. Allowing illegal immigrants to have free education and health care incentivized millions of them to enter the country. This depressed the wages of working class Americans.
Activist judges are doing their best to stymie President Trump, ruling against virtually all his policies. For example, under President Obama, the courts ruled that states had no right to determine immigration policy. With President Trump, activist judges not only allow states to ignore the President’s policy, they have even allowed liberal bastions to declare themselves “Sanctuary Cities,” blocking local law enforcement from cooperating with ICE (Immigration and Customs Enforcement) to arrest illegals. One activist judge has even been accused of allowing an illegal immigrant to escape from the back door of her courthouse!
But President Trump has been slowly rendering our courts more conservative, as manifested by a recent judicial decision to allow money allocated to the Defense Department to be used to build a wall on our southern border to hinder illegal immigration.
The Democrats and their acolytes are not amused. They had visions of the Hillary Clinton presidency using the judicial system to confiscate guns, impose regulations to combat climate change, rule that illegal aliens who paid taxes are now citizens and eliminate the Electoral College – goals that could never be achieved via democratic process. If fact, Democratic presidential candidates such as Elizabeth Warren and Kamala Harris have promised to consider packing the Supreme Court by increasing the number of justices.
Americans will have a clear binary choice in 2020. Is the country to be governed by judges or by elected officials? Savvy Democrats prefer a more electable moderate who quietly promises to appoint activist judges. Such a candidate may defeat President Trump. And then when the judges that candidate appoints imposes the Green agenda, confiscates guns and abolishes the Electoral College, the Democratic president can throw up his (or hers) hands and lie “I had no idea my appointees would take such action, but this is now the Law of the Land.”
But once a Democratic nominee is chosen, I would not be surprised if President Trump challenges this person saying “Name your judges. I have already done so. The American people have the right to know the judicial philosophy of your potential appointees. We have the right to govern ourselves. Not by Ivy League elitist judges who consider half the country to be disgusting ignorant deplorables.”
Then what will the Democratic nominee do? And how will the liberal media react to protect that nominee? Stay tuned.
